Clearing a Line
All Members are obliged to inquire as to whether another Member of the Association is or was representing a line when it is offered to them. If the line is or was represented by another Member of the Association, the member must ensure that the line is cleared before entering into negotiations of any kind for the purposes of agreeing to accept the line. The Member will do so by notifying the previous or current representative of the offer to the line in order to ascertain whether the manufacturer fulfilled all of its contractual obligations, such as payment of outstanding commissions, providing proper termination notice, and fulfilling other such obligations. If the previous or current representative indicates that the manufacturer has fulfilled all of its contractual obligations, then the line will be considered clear.
If the previous or current representative indicates that the manufacturer has not fulfilled all of its contractrual obligations or if the member is not able to contact the previous or current representative after reasonable attempts to do so, then the member must make a written application to the Association to have the line cleared.
